Assume you are a judge, what would be your take on Coca Cola paying $2,7 million to get the Bottling Plant acquired by Mr. Mawere using his ARL group of companies i.e. FLAM and his SA subsidiary companies that were expropriated with Coca Cola’s complicity and financing?

A retired judge, a member of the JUSTICE UNDER RULE OF LAW (JUROL) initiative powered by Africa Heritage Society’s (AHS) civics literacy campaign using real life case studies. in response to this question by a member of JUROL, “Assume you are a judge, what would be your take on Coca Cola paying $2,7 million to get the Bottling Plant acquired by Mr. Mawere using his ARL group of companies i.e. FLAM and his SA subsidiary companies that were expropriated with Coca Cola’s complicity and financing?” responded as follows:

As a judge, I would take a very dim view of Coca Cola’s actions in this case.

Coca Cola’s payment of $2.7 million to acquire the bottling plant that was expropriated from Mr. Mawere and his ARL group of companies is a clear case of complicity in the expropriation. Coca Cola knew that the expropriation was illegal and that it was violating the property rights of Mr. Mawere and his companies.

By paying $2.7 million to acquire the plant, Coca Cola was effectively rewarding the Zimbabwean government for its illegal actions. Coca Cola was also sending a message to other companies that they could expropriate property with impunity, as long as they were willing to pay Coca Cola a fee.

I would rule that Coca Cola’s payment of $2.7 million was illegal and that it should be returned to Mr. Mawere and his companies. I would also order Coca Cola to pay damages to Mr. Mawere and his companies for the losses they suffered as a result of the expropriation.

In addition to the legal issues, I would also be concerned about the ethical implications of Coca Cola’s actions. Coca Cola is a multinational corporation with a global reputation. By participating in the expropriation of Mr. Mawere’s property, Coca Cola was tarnishing its reputation and undermining its commitment to corporate social responsibility.

I would hope that Coca Cola would learn from this experience and take steps to ensure that it does not participate in any future expropriations. Coca Cola should also take steps to make amends to Mr. Mawere and his companies for the losses they suffered.
