Dear Governor Mushayavanhu,

I trust this letter finds you well.

I am writing to you on behalf of the BOAF-10POL-JLI-AI AFRICA initiative, powered by the Africa Heritage Society (AHS), a non-profit organization dedicated to promoting accountable governance in Africa. The AHS works to inspire the shaping and building of democratic systems based on constitutional values.

Our attention has been drawn to a video containing your assertions made at the 25th anniversary celebrations of DMH Attorneys in June 2023.

As you are aware, the Constitution of Zimbabwe is the supreme law of the land (Section 2(1)). It mandates that all actions and decisions comply with its principles, including upholding the rule of law and separation of powers (Section 3(1)).

Furthermore, Section 62(2) guarantees the right to access information, crucial for public scrutiny. Section 172(1)(c) empowers the High Court to address alleged misrepresentations or violations of constitutional principles.

Specifically, your statements regarding the founding of FBC Bank and its relationship with DMH Attorneys raise concerns about accuracy and transparency. DMH’s establishment in 1998 seems to contradict its involvement in drafting FBC Bank’s documents, which commenced operations in August 1997.

As Governor, your conduct is held to the highest standards. Any inconsistency with the facts could erode public trust in our institutions.

We urge you to reflect on these provisions and ensure your actions align with the utmost accountability and truthfulness. Upholding these principles is vital for a just and transparent society.

Thank you for your attention to this matter. We look forward to your response and continued commitment to constitutional values within the next week.
