The reconstruction of SMM, led by President Mnangagwa, has unraveled its inherent and systemic web of misrepresentation, manipulations, and violations that extend beyond the borders of Zimbabwe.

At the heart of my decision to launch a collateral attack on the intervention judgment that was handed down by the High Court of South Africa on Thursday, December 21, 2023, in Johannesburg, South Africa, in relation to your application seeking the Master of the High Court to comply with the obligations imposed on this organ of state to protect, uphold and respect s. 2 of the Constitution of South Africa that provides that the constitution is the supreme law and any law or conduct that is inconsistent with the it is void ab initio, the discovery that this promise of constitutional supremacy is not binding on all organs of state, was not only shocking given that my decision to compel the Master of the High Court of South Africa was founded on real case studies involving the direct and wanton abuse of public power inherent in the SMM reconstruction affair.

A deeply concerning revelation that the authority for a state-appointed administrator, Mr. Gwaradzimba, who was appointed under a reconstruction decree promulgated using the Presidential Powers vested in the President of Zimbabwe to make laws without parliamentary involvement and knowledge, and an associated ministerial reconstruction order that was issued by Chinamasa, a close ally of Mnangagwa, on September 6, 2004, without affording the shareholders and directors of 26 companies employing 20,000 people, including CFI, resulted in the brazen theft of CFI shares under the very nose of the Master and liquidators, inclusive of the SA courts.

This audacious act of impunity exemplifies a blatant disregard for legal processes and ethical standards, shaking the foundations of justice. This conduct, practice, and custom that has come to define who Mnangagwa is seems to have no step to it as evidenced by the Tshabangu-centric recall of CCC MPs and Councilors using the weapon of s. 129(1)(k) of the Constitution of Zimbabwe that gives political parties discretional power and authority to recall their sponsored and elected public office bearers,” said Dr. Shumba.

Ms. Alisha Smith, the Team Leader for the JLI-AI South Africa initiative, stated: “The orchestrated reduction of an SMM under reconstruction claim against SAS, a South African company whose sole shareholder was Mawere, leading to the theft of CFI shares, demonstrates a deliberate and arbitrary manipulation of the legal system. The timing of this maneuver, coinciding with efforts to claim the CFI shares, exposes a direct linkage and a motive that goes beyond the facade of legitimate reconstruction,” said Ms. Alisha Smith.

Professor Mupasiri, the applicant in the matter under Case Number CCZ 34/21 seeking to impeach President Mnangagwa for his knowledge and involvement in giving birth and prosecuting the corrupt, fraudulent, and manipulated reconstruction scheme against all companies deemed to be under the control of Mawere for ulterior motives, stated: “Furthermore, the involvement of Mr. Gwaradzimba, as an extra-judicially appointed Administrator of SMM, raises serious questions about the legitimacy of the entire process. The alleged collusion, misrepresentation, and abuse of legal procedures in the liquidation of SAS underscore the systemic challenges that have allowed such audacious acts to take place.”

Mr. Devine Mafa, a member of the JLI-AI USA and an American citizen of Zimbabwean descent, asserted: “I am grateful to have connected the dots that the fate of SMM is no different from my own father, whose election as a Senator pursuant to the August 23, 2023, harmonized elections, was subjected to Mnangagwa-led recalls, which was intricately linked to the reconstruction or recall of SMM’s shareholders and directors outside the four corners of legality, legitimacy, and constitutional validity.  Consequently, I decided to join the Dr. Shumba-led efforts to hold Mnangagwa to account for his role in the destruction of Mawere’s business interests not only in the jurisdiction of Zimbabwe but in South Africa, saying: “As Dr. Shumba challenges the intervention judgment, it is crucial to highlight that the theft of CFI shares is not merely a corporate affair—it symbolizes a broader assault on the rule of law, transparency, and the principles that underpin ethical governance. By shedding light on these egregious actions, we strive to hold those responsible accountable and protect the very essence of justice that should guide our legal systems.”
