At the heart of my decision to challenge the intervention judgment on a collateral basis lies a profound revelation—the audacious theft of CFI shares transpiring under the very nose of the Master and liquidators, both within the jurisdiction of Zimbabwe and beyond, including the courts in South Africa. This revelation serves as a wake-up call to the systemic challenges that plague our institutions, allowing such blatant acts of impunity to persist.

The reconstruction of SMM, orchestrated by President Mnangagwa, has laid bare a pattern of misrepresentation, manipulations, and violations that extend far beyond Zimbabwe’s borders. The very essence of justice is at stake, and the theft of CFI shares symbolizes an assault on the rule of law and transparency.

The recent intervention judgment handed down by the High Court of South Africa on December 21, 2023, has fueled my determination to challenge this affront to justice. The authority wielded by a state-appointed administrator, Mr. Gwaradzimba, in a reconstruction scheme bereft of parliamentary involvement, resulted in the brazen theft of CFI shares.

This act of impunity is not isolated; it mirrors a larger pattern in the Mnangagwa-led strategy, as evidenced by the Tshabangu-centric recall of CCC MPs and Councilors. The weaponization of legal provisions for political gain is a dangerous precedent that threatens the very fabric of democracy.

The orchestrated reduction of SMM’s claim against SAS, leading to the theft of CFI shares, is emblematic of a deliberate manipulation of legal processes.
