“It is not in dispute that it is provided for by law that anyone in possession of a valid refugee or immigration status is eligible to make a formal application to set aside certain prescribed requirements for a visa application e.g.

  1. Submission in the home country
  2. Challenge in obtaining a police clearance from home country
  3. Saqa evaluation
  4. Department of labour Certificate and many more.

A General Work Visa Waiver is one that is done to set aside the requirement that in order to be eligible for a work visa, it is mandatory that one complies with the specification that a labour Certificate be sought and obtained to confirm that no employment prejudice would by granting a permit to work in South Africa to an applicant.

Although one may possess critical skills required by the market, such skills offered may already be abundantly available in the country and as such granting a waiver may be deemed as prejudicial to domestic job seekers.

In the premises, it would be an understatement that this certificate requirement can and is often a show stopper.

A prospective applicant has to provide sound and cogent justifications of why it would be in the national interest for the Minister to grant a waiver or exemption, especially having regard to the high domestic unemployment that is a cause of social problems.

Having a positive General Work Visa Waiver Application does not necessarily give the applicant legal status in SA.

Therefore the need to apply for the General Work Visa main application.

In most cases, both waiver and main application are submitted once in your home country if it’s your first application or when your current permit has already expired.

There are very slim chances of success if one doesn’t possess, the requisite academic qualifications, skill sets, and experience.
