“Where there is the Rule of Law, Justice is the consequence,” says Mr. Goodman Musariri

Mr. Goodman Musariri, a member of the Justice Under Rule of Law (JUROL) initiative stated “Where there is the Rule of Law, Justice is the consequence,” and asserted further that: “The Bible says something remarkable about God: “Where the spirit of Jehovah is, there is freedom.” (2 Corinthians 3:17) in recognition that the inalienable right of liberty that the creator endowed on all human actors is alive when the rule of law is the standard against which public office bearers are judged.

Below is Mr. Musariri’s first installment under the Civics Literacy Program aimed at building ecosystems that are founded on constitutionalism and rule of law principles and values:

“One cannot think or talk about Justice Under Rule of Law and Man’s Quest For Freedom Under Law and Rule of Law without talking about the MAGNA CARTER or The Great Charter and how this document has been described as the “single most significant legal document in the history of the WEST which marks the origin of the RULE OF LAW.

• The charter curbed the monarch’s power and stipulated that he, like all his subjects, was now subject to the rule of law.

• I shall detail in my full article how even according to Winston Churchill, a renowned 20th-century historian and prime minister of England , Magna Carta provided “a system of checks and balances which would accord the monarchy its necessary strength, but would prevent its perversion by a tyrant or a fool”.

• Historically, the constitutional significance of Magna Carta has depended much on what the charter said than on what was thought to have been said,” acknowledged Lied Bingham, who was Lord Chief Justice of England and Wales from 1996 to 2000.

• When the representatives of the fledgling nation met to draft a constitution for the United States of America, they upheld the principle of freedom under law.

• The U.S Bill of Rights descends from this acceptance. Thus in 1957 and in recognition of the Magna Carta, the American Bar Association erected at Runnymede a monument bearing the inscription, “To Commemorate Magna Carta – Symbol of Freedom Under Law.”

• In 1948, American Stateswoman Eleanor Roosevelt helped to draft the United Nations Declaration of Human Rights, hoping that it would become “the international Magna Carta of ALL men everywhere.”

• Indeed the history of the Magna Carta shows how profoundly the human family yearns for freedom.

• Despite noble aspirations, today basic human rights remain under threat in many countries.

• Human governments have repeatedly shown themselves unable to guarantee freedom for all even through CONSTITUTIONALISM DEVELOPMENT, CONSTITUTIONALITY AWARENESS, AND CONSTITUTIONAL ORDER which are the quintessential elements necessary to shape JURISPRUDENCE.

• So my article will detail the very origin of the MAGNA CARTA right from English King John who reigned (1199-1216) and met opposing barons, powerful landowners disgruntled by royal excesses.

• The barons demanded that the king appease their grievances by conceding certain rights.

• Under tremendous pressure the king finally affixed his seal to a document that later became known as Magna Carta ( The Great Charter).

I shall have to write my full article so as to give an overview of how the RULE OF LAW came to be.

• Of interest is why CONSTITUTIONS are still dedicated to God Almighty and as Prophet Bokolings may I conclude my highlights by quoting from the Christian Bible :

So if we are to talk of Justice Under the Rule of Law: we must be interested in knowing about the kind of freedom God’s Kingdom offers mankind through SUNTHEKE COVENANTS ( Between God Almighty and Man) versus the various freedoms that man has attempted to do through DIATHEKE COVENANTS ( Between Man and Man) through CONSTITUTIONALISM DEVELOPMENT and Laws of Contract etc.”
